SCC Online Shop Terms and Conditions
These terms and conditions govern your use of this website and your relationship with South Caernarfon Creameries. Using the website indicates that you accept these terms and conditions regardless of whether or not you choose to register with us. If you do not accept these terms and conditions, please do not use the website.
- Introduction
This website is provided for your personal use, subject to these terms and conditions. By using the website you agree to be bound by these terms and conditions.
Registration
2.1. It is your responsibility to ensure that all information that you provide to us on registration is accurate and complete. You must inform us immediately of any changes to that information.
2.2. When you register with the website you will be asked to create a password. You must keep this password confidential and not disclose it or share it with anyone. You will be responsible for all activities that are carried out using your password.
2.3. If we have reasonable grounds to suspect that any information you have provided to us is inaccurate or incomplete, or if you breach any of your obligations under these terms and conditions, we reserve the right to suspend or terminate your registration immediately. We may then refuse to supply the order or to allow you to use the website.- Price
3.1. If any goods are shown on the website at an incorrect price due to a typographical or other error, we reserve the right to refuse to supply those goods to you at that price, provided that we notify you before we dispatch the item concerned.
3.2. Postage and delivery charges are stated in your basket total amount and are not included on the individual products shown. - Payment
4.1. You can pay using your debit or credit card.
- Availability of goods/colour and sizing
5 .1. No contract will come into place between South Caernarfon Creamery and the customer until we actually dispatch the goods to you. Until that point, we may decline to supply the goods to you for any reason.
5.2. If we are unable to supply a particular item, we will notify you as soon as possible.
5.3. If any goods you order are not available, we reserve the right to supply you with substitute goods of equivalent quality and price. If we do this and you decide to return the goods to us, we will bear the costs of such return.
5.4. The colour and sizing of products shown on the website can only be used as a guide and colours and sizes may differ slightly from product to product. We may also make variations to the products shown on the website but these will not affect their quality.
Delivery and delivery charges
6.1. Delivery will be made to the address in the United Kingdom which you provide to us as the delivery address when submitting your order. South Caernarfon Creameries will not deliver to addresses outside the UK. The Distance Selling Regulations do not apply as the goods sold are perishable, however, if we have not delivered the goods within 30 days of the date that you ordered then you may cancel the contract and we will refund any money paid by you.
6.2 All orders are dispatched once per week, on a Tuesday and will be delivered by Royal Mail Special Delivery Next Day which will mean that most UK postcodes in England, Wales, Northern Ireland and mainland Scotland will be delivered by 1pm Wednesday. We will do our best to dispatch the goods the Tuesday following your order but will not be liable for delay in delivery arising as a result of any cause beyond our reasonable control. Orders will be accepted up until 12 noon Monday for dispatch the following day. Orders placed after 12 noon Monday will be dispatched on Tuesday of the following week.

7 Your right to cancel
7.1. You have the right to cancel any order within 7 working days of receipt of the goods from us, with the exception of the following (unless they are faulty):
7.1.1. Any goods which, by reason of their nature cannot be returned or which are liable to deteriorate or expire rapidly.
7.2. Please send notice of cancellation by email to sales@sccwales.co.uk or call us on 01766 810251 stating your name and order number and details.
7.3. If the goods have already been dispatched at the date of receipt of your cancellation, you must return the goods to us unused and with the original packaging intact and repackaged securely to South Caernarfon Creameries Ltd, Rhydygwystl, Chwilog, Pwllheli, Gwynedd
LL53 6SB and we will credit you. This should be for the price of the goods, within 30 days, beginning with the day on which notice of cancellation was given.
7.4. If you do not return the goods within 21 days of cancellation, we will make a charge in respect of the cost of recovering the goods. If you do not return the goods within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, and you will be charged for them.
7.5. If an item is returned which is not faulty, you will be refunded the costs of the goods and the postage and packaging charges, but not the return postal charges.
- Faulty Returns
If any product you purchase develops a fault within 12 months of the date of dispatch, simply return it to us with proof of purchase and written details of the fault and we will send you a replacement (or the closest available equivalent).
Limitations on use of Website
9.1. You are prohibited from posting or transmitting to or from the website any material:
9.1.1. That is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; or
9.1.2. For which you have not obtained all necessary licenses and/or approval; or
9.1.3. which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world; or
9.1.4. Which is technically harmful (including, without limitation, computer viruses).
9.2. You may not misuse the website (including, without limitation, by hacking).
Amendments
We may update these terms and conditions from time to time and will notify these changes to you by posting the amended terms and conditions on the website. The changes will apply to all use of the website after we have posted the new terms and conditions. If you continue to use the website after the date on which the change comes into effect, your use of the website will indicate your agreement to be bound by the new terms and conditions.- Links to and from the Website and advertising
11.1. Links to third party websites on the website are provided solely for your convenience. If you use these links, you leave the website. We have not reviewed all of these third party websites and do not control and are not responsible for these websites or their content or availability. We therefore do not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the website, you do so entirely at your own risk.
11.2. The website may contain third party advertising and sponsorship. We are not responsible for the content of such material .
- Service access and limitations on use of website
12.1. While we endeavour to ensure that the website is normally available 24 hours a day, we will not be liable if for any reason the website is unavailable at any time or for any period.
12.2. Access to the website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
12.3. We will not be liable for any incompatibility of the website with any of your equipment, software or telecommunications or the failure of the website to meet your requirements. - Intellectual Property

13.2. By registering and placing orders with us, you agree to us using your personal details in accordance with our privacy policy.
- International use
15.1. We make no promise that material on the website is appropriate or available for use in locations outside the United Kingdom. Accessing the website from territories where its contents are illegal or unlawful is prohibited. - General
16.1. If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.
16.2. If you breach these terms and conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the terms and conditions.
16.3. We will not be responsible for any breach of these terms and conditions caused by any circumstances beyond our control.
16.4. A person who is not party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
16.5. These terms and conditions do not affect your statutory rights.
16.6. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. - Privacy Policy
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998) and according to the Which? Web Trader Code of Conduct.
We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.
We will not e-mail you in the future unless you have given us your consent. We will not pass your e-mail address to third parties. Information we will collect about you includes: your name, address, phone number, email address, credit/debit card details. We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy and the law. Cookies are used on this shopping site, but only to keep track of the contents of your shopping cart once you have selected an item.
